Insurer won't pay?
No Problem.

In Bello, a retaining wall attached to our client's home was damaged in a wind storm.  Their insurance company, Merrimack, failed to cooperate and properly adjust the claim.  The carrier argued that the wall wasn't covered under the the homeowner's policy, and even if it was, the damage wasn't caused by wind.  In short, Merrimack refused to honor its duty to pay, and made every excuse not to do so.

Joel took the case, even though this type of lawsuit was notoriously difficult to win.  At trial, Joel successfully argued that not only was the damage covered by the policy, but also that the insurance company acted in bad faith by denying the claim as they did.  The jury entered an award in favor of our client, and in excess of the policy limits.

Ultimately, Garber Law recovered just under $1.1 million for our client.  And today, this case is still one of the only successful first-party insurance bad faith cases ever tried in New Jersey.
